The Wall Street Journal: Supreme Court Weighs Limits in Fraud Prosecutions

The US Supreme Court heard arguments yesterday in Ciminelli v. United States, where real estate developer Louis Ciminelli is challenging the “right to control” theory of fraud in an attempt to overturn his conviction of bid rigging charges. Ciminelli was sentenced to more than two years over claims that he schemed to defraud taxpayers in a New York state funded manufacturing project in Buffalo. Michael Dreeben, Ciminelli’s attorney from O’Melveny & Myers LLP, said that the “right to control” theory is a “made-up doctrine with no roots in the statute.”
