WASHINGTON, DC—October 13, 2021—O’Melveny today announced that David V. Most recently, Harbach was with the Kosovo Specialist Prosecutor’s Office in The Hague, Netherlands, where he co-led an investigation into crimes against humanity and war crimes committed during the Kosovo conflict in the late 1990s.

A seasoned trial lawyer, Harbach has tried more than 35 cases to verdict in federal and state courts. He has also conducted some of the nation’s highest profile public corruption trials, including cases against former U.S. Senator John Edwards and former Virginia Governor Robert F. McDonnell.

Harbach was an Assistant U.S. Attorney in the Southern District of New York from 2005 to 2010, and for four years beginning in 2015, Harbach was an Assistant U.S. Attorney in the Eastern District of Virginia. In 2016, he was appointed Managing Assistant U.S. Attorney and Criminal Supervisor of the Richmond Division office, overseeing 21 prosecutors.

From 2014 to 2015, Harbach served on detail as Special Counsel to FBI Director James Comey. Before his work with the FBI, Harbach served as a Trial Attorney in the DOJ Criminal Division’s Public Integrity Section, earning the Deputy Chief title after two years.

Early in his career, Harbach served as an Assistant District Attorney in Houston, and as a surface warfare officer in the United States Navy.

“With his long history of government and military service, David is the epitome of a public servant, which fits perfectly with O’Melveny’s values,” said firm chair Bradley J. Butwin. “And as a highly decorated trial lawyer, his litigation skills will benefit our clients immensely.”

“David has prosecuted everything from complex white-collar and violent-crime cases to narcotics and RICO cases, including various financial fraud, corruption, and campaign-finance violations, and most recently, crimes against humanity,” added Steven J. Olson, co-chair of O’Melveny’s White Collar Defense & Corporate Investigations practice. “These experiences will benefit our clients.”

“We believe the knowledge and skills David has drawn from these diverse experiences will directly benefit our corporate investigations clients,” added Michael R. Dreeben, co-chair of White Collar Defense & Corporate Investigations practice.

”What an honor and privilege it is to be joining such a talented and collegial collection of professionals at O’Melveny,” Harbach said. “The firm has a long history of excellence, and I am thrilled about the opportunity to become part of continuing that tradition.”
