KohSweeney Named National Law Journal 2019 “Employment Trailblazer”

LOS ANGELES—March 14, 2019—The National Law Journal has named O’Melveny partner Adam KohSweeney to its list of “Employment Trailblazers.” This award recognizes lawyers in the field whom the NLJ has identified as “agents of change.”

A profile of KohSweeney discussed his practice in the airline industry.

“There is a burgeoning area around plaintiffs’ lawyers and local and state governments trying to enforce local employment laws for flight crews,” said KohSweeney. He cited two such major cases he handled in California, Ward v. United Airlines, which involved pilots, and Vidrio v. United Airlines, which involved flight attendants. “We prevailed in both because state employment laws should not apply when workers spend less than half their time on the ground in California,” KohSweeney said.

KohSweeney also told the publication that the area of employment litigation would continue to grow. “There is a lot of give and take,” he said. “If you look at arbitration cases, there was a long list of Supreme Court cases up until Epic Systems Corp v. Lewis, but now all the arguments against arbitration have finally been shot down. Still, it took a long time. There is every incentive now for private plaintiffs to pursue claims, and we will see more back and forth. So it will be exciting for years to come.”
