Brandon Amash brings a strategic eye to high-stakes civil, class action, enforcement, and regulatory matters involving an extensive range of product liability, consumer fraud, fair lending, housing discrimination, false advertising, and commercial and shareholder disputes. He has authored and argued successful briefs from dismissal through appeal in state and federal courts throughout the country in all manner of False Claims Act, civil fraud, contract, consumer protection, and tort matters.

Brandon is also experienced in providing guidance and regulatory counseling to clients in internal and government investigations. Brandon has advised on matters involving Medicare and Medicaid regulations, the Affordable Care Act, and other laws regulating managed care organizations. He has also advised on matters involving the Fair Housing Act and related state and federal laws regulating various institutions.

Brandon dedicates significant time to pro bono work, focusing on immigration, political asylum, and civil rights matters, for which Orange County’s Public Law Center named Brandon Attorney of the Year in 2021. Brandon also coaches a local high school mock trial team and serves on the Associate Board of the Constitutional Rights Foundation of Orange County, a non-profit organization dedicated to civic and law-related education programs.

  • Successful defense of the sponsor/manager of five major commercial real estate investment funds in an arbitration and judicial reference in which claimant investors sought over $300 million in damages on contract and breach of fiduciary duty claims
  • Obtained complete victory on behalf of four commercial real estate investment funds in a three-week arbitration involving profit sharing claims, and obtained and secured on appeal a judgment for the funds of over a half million dollars in damages on counterclaims and over $2.5 million in attorneys’ fees and costs
  • Representing major consumer electronics company in an appeal of a favorable judgment dismissing product liability and breach of contract claims
  • Counsel for a leading automobile maker against engine defect product liability claims
  • Defending major national financial institution in multiple putative class actions involving COVID-19 relief programs
  • Defending major computer chip maker in putative class action involving merchantability and consumer fraud claims
  • Counsel for managed care organization in civil investigation by the Department of Justice and local United States Attorneys’ Office
  • Defended national managed care organization in civil and criminal investigations by the Department of Justice and local United States Attorneys’ Offices related to allegations of health care fraud in diagnosis code submissions
  • Defended government-sponsored enterprise in major fair lending litigation regarding maintenance of REO properties
  • Defended managed care organization and secured dismissal in numerous False Claims Act qui tam matters
  • Defended national managed care organization in an internal review of its compliance with Medicare Advantage risk-adjustment reimbursement rules
  • Obtained reversal on appeal of immigration court’s denial of asylum claims and secured client’s release from immigration custody following a habeas evidentiary hearing, and pursuing revived asylum claims on remand
  • Authored numerous amicus briefs, cert petitions, and merits briefs in the United States Supreme Court, Texas Supreme Court, and other state and federal courts
