Cason Cole has a broad range of experience representing technology companies with high-stakes intellectual property matters. On the litigation side, he has worked with clients across all stages of IP cases, including fact and expert discovery, claim construction, dispositive motions, and trial. In addition, he has prosecuted patent applications and conducted pre-suit investigations. Cason has also practiced before the USPTO in inter partes review (IPR) proceedings. Cason’s experience spans a wide array of technologies, including semiconductors, data networking, cellular technologies, medical devices, oil and gas equipment, and financial services software.

Cason’s experience as a law clerk to Chief Judge Rodney Gilstrap in the Eastern District of Texas gives him a unique insight into patent litigation procedure and trial practice. During the clerkship, Cason assisted with over a dozen patent infringement jury trials, as well as dozens of pretrial conferences, claim construction hearings, and other motions hearings. Cason now leverages this experience to strategically navigate litigation in courts throughout the country and secure the best possible outcome for clients.

Before law school, Cason worked in the transportation industry as a civil engineer, where he gained significant experience managing high-impact projects, complex teams, and scarce resources.

  • Defended chip manufacturer in patent case involving six patents related to power management and processor hardware, including preparation of IPR petitions.  (E.D. Tex.)
  • Defended financial institution in patent case involving five patents related to methods of testing mobile applications.  The case settled favorably shortly before the close of fact discovery.  (E.D. Tex.)
  • Advised chip designer and manufacturer concerning ICC arbitration, licensing, and potential trade secret, contract, and copyright claims relating to 5G telecommunications technology.
  • Defended consumer electronics company in patent case related to smart watch devices. (W.D. Tex.)
  • Defended oil and gas drilling company in patent case involving eight patents related to automated drilling, including preparation of three IPR petitions (N.D. Tex.)
  • Defended wireless carrier in patent case involving ten patents related to antenna arrays, resulting in favorable settlement shortly before closing arguments to the jury (E.D. Tex.)  
  • Advised information standards organization on licensing, patent litigation, and intellectual property risks associated with business transactions
  • Prosecuted patents related to banking technology, aerospace/defense industry systems and software, and semiconductor manufacturing
  • Conducted pre-suit investigations on behalf of a major telecommunications equipment provider, identifying non-infringement and invalidity positions and driving favorable business resolutions
