Ilan Borochov is a litigator in O’Melveny’s New York office who focuses his practice on consumer class actions, product liability cases, mass torts, and complex commercial business disputes. Ilan regularly serves as national coordinating counsel for multi-jurisdictional mass-tort and products liability litigations, including those brought by state attorneys general.
Ilan also maintains a robust business litigation practice, representing plaintiffs and defendants through all phases of litigation in federal, state, and bankruptcy courts (including arbitrations) in complex “bet-the-company” disputes related to breach-of-contract claims, breach-of-fiduciary-duty claims, business torts (including securities fraud and other transactional fraud), investor litigation, fraudulent transfer and asset recovery claims, internal governance disputes between partners, LLC members or from mergers and acquisitions, ultra vires claims against officers or directors, legal malpractice claims, and defamation/business disparagement claims.
Ilan has experience in litigating cases across a broad array of industries, sectors, and areas of litigation, including D&O litigation, securities, health care, pharmaceuticals, real estate, business divorce, oil and gas, and restaurant and hospitality. Drawing from his business background prior to practicing law and his experience in different industries and sectors, Ilan is a trusted advisor to companies, directors, and officers navigating through sensitive company disputes. Because he makes it a priority to learn the intricacies and nuances of his clients’ operations, Ilan is frequently invited to sit in on board meetings to provide sound legal advice that also considers the practicalities of his clients’ business.
While part of many successful trial teams, some of Ilan’s notable victories include:
- Secured dismissal of antitrust claims brought by X and Rumble against a global organization representing the interest of major marketers that refused to advertise on X and Rumble
- Favorably settled claims against a Fortune 500 company brought by state attorney generals related to violations of state environmental law
- Obtained dismissal of all claims related to alleged breaches of fiduciary duties and fraudulent transfers that sought over hundreds of millions in damages, which were brought by a bankruptcy trustee, against the former chairmen of the board of the third largest health care laboratory testing facility
- Secured dismissal of all claims brought against hospital system relating to alleged installation of defective medical devices
- Lead associate on a team that obtained dismissal of all claims brought by a global food-and-beverage group purchasing organization (GPO) against another GPO relating to disputed procurement and usage of restaurant-member data for rebate processing purposes. Precedential decision affirmed by the Court of Appeals for the 5th Circuit (No. 33-10340, 2023 WL (5th Cir. Sept. 12, 2023))
