The seemingly sudden ubiquity of AI—from reading x-rays and detecting credit card fraud to powering intelligent cars and doling out investment advice—has left some firms flat-footed. BH Management Services

O’Melveny secured a major victory for BH Management Services, B.HOM Student Living, and Timberline Real Estate Ventures (TREV)—and for a joint defense group comprised of 60 defendants—in cutting-edge class action litigation involving algorithmic pricing and artificial intelligence.

Consumer Electronics Company

Defended a well-known consumer electronics company in a trade secret misappropriation case regarding machine learning algorithms for app recommendations. Our team was preparing for trial when, less than a week before, we obtained summary judgment on every claim that the plaintiff had asserted against our client, resulting in a clean-sweep victory for our client.

Global Pharmaceutical Company

Advising a global pharmaceutical company on AI-based risk and avoiding biased outcomes in the use of AI-based tools.

Health Care Insurer

Conducted an internal investigation on behalf of a health care insurer in response to a government inquiry as to whether AI software used by the insurer, which forecasted the health care needs of consumers, produced biased results against certain racial and ethnic groups.

Kakao Healthcare

Counseled Kakao Healthcare in its US$5 million Series A financing and US$10 million convertible note investment in Enolink Holdings, developer of an AI-based predictor of disease and drug efficacy.

Leapforce

Advised Leapforce, a search service provider, on its acquisition by Appen Limited, an Australian data solutions and services provider specializing in machine learning and artificial intelligence applications.

Memomi

Guided Memomi, developer of an AI-enabled, augmented reality mirror, in its acquisition by Walmart.

Samsung

Secured an eve-of-trial success for Samsung in patent litigation involving six patents and 30 claims pertaining to machine learning technology used for face detection and dozens of Samsung products.
