AIPLA: AI and Patent Prosecution: Where are we Now

O’Melveny partner Mark Liang will moderate a panel discussion on the current AI and patent prosecution landscape at the 2026 American Intellectual Property Law Association Spring Meeting. The event will cover the intersection of innovation and intellectual property law as AI technologies continue to evolve, as well as consequential opportunities and safeguards.
AI-related litigation is central to Mark Liang’s practice, with a particular emphasis on data scraping, computer fraud and security statutes, and agentic browsing litigation. In the context of these matters, he has successfully litigated claims under the Digital Millennium Copyright Act (DMCA), Computer Fraud and Abuse Act (CFAA) and its state analogues, and breach of contract claims, including based on violations of terms of use. He has won preliminary injunctive relief for plaintiffs and also counseled clients regarding such claims. Liang also has extensive experience advising clients on matters pertaining to standards-essential patents, including F/RAND damages and obligations to standards setting organizations.
