The US District Court for the Northern District of California granted American Airlines’ motion to dismiss a complaint accusing the airline of age discrimination in employee retirement programs offered to flight attendants during the pandemic. American contended that the claim was subject to dismissal because the plaintiffs failed to show that the retirement program was an adverse employment action. American is represented by Mark Robertson and Kelly Wood of O’Melveny & Myers LLP.
