The Intellectual Property Strategist: Federal Circuit Provides Guidance on IP Case Transfer Motions

O’Melveny partners Darin Snyder and Brad Garcia, counsel Amy Liang, and associate Daniel Silverman contributed an article to Law Journal Newletters’ The Intellectual Property Strategist analyzing recent Federal Circuit opinions supporting the transfer of patent infringement suits from the Western District of Texas to more convenient venues, and how these rulings can offer insights for courts and litigants on the appropriate analysis for transfer motions.

The authors analyze a number of decisions involving prominent technology companies that “provide guidance on several recurring issues that defendants, and courts, should be especially attuned to,” including the primacy of witness convenience and the impact of co-pending litigation.
