Law360: Full 9th Circ. Won’t Review Antitrust Suit Against Chipmakers

The Ninth Circuit denied a group of plaintiffs' motion to revive a putative class action accusing Samsung Electronics Co., Micron Technology Inc., and SK Hynix Inc. of fixing prices on dynamic random-access memory (DRAM). The panel’s decision follows a Ninth Circuit ruling in March that affirmed a California district court’s dismissal of an indirect-purchaser lawsuit against the chipmakers, finding that the complaint did not plausibly suggest an agreement to fix DRAM prices. Samsung is represented by Ian Simmons, Stephen McIntyre, Kurt C. Brown, and Brian P. Quinn of O’Melveny & Myers LLP.
