Law360: Match Can’t Avoid Google’s Breach Claims In Play Store MDL

US District Judge James Donato denied Match Group’s motion to dismiss Google’s counterclaims accusing the app developer of evading contractual obligations to pay fees from in-app payments. Match Group, along with a number of other app developers, filed suits against Google for monopolizing the app distribution market and payment system on its Play Store. The tech giant countersued Match Group in July for breach of contract. Match’s dismissal motion “indicates on its face that it is premised on facts outside the scope of the pleadings,” the judge stated. Google is represented by Ian Simmons, Benjamin G. Bradshaw, Daniel M. Petrocelli, and Stephen J. McIntyre of O’Melveny & Myers LLP.
