Thomson Reuters Westlaw Today: Supreme Court Won’t Hear New Mexico Stream Access Dispute

The US Supreme Court rejected Chama Troutstalkers LLC and Z&T Cattle Co. LLC’s certiorari petition seeking the review of a state high court decision that eliminated regulations restricting public access from non-navigable waters flowing through private property. The regulation was issued in 2018 by the New Mexico State Game Commission, which granted certificates to Chama and Z&T. Outdoor recreation groups, including the Adobe Whitewater Club of New Mexico, filed a petition with the New Mexico Supreme Court arguing that the regulation should be negated. Heather Welles of O’Melveny & Myers LLP represented the recreation groups.
