Daily Journal Names Eberhart, Snyder 2021 “Top Trade Secret Lawyers”

SAN FRANCISCO–October 6, 2021–O’Melveny partners David Eberhart and Darin Snyder have been named among the Daily Journal’s 2021 “Top Trade Secret Lawyers.” The list features the editor’s selection of the 25 leading lawyers practicing trade secrets law in California.

The Daily Journal recognized Eberhart as “one of the firm’s most experienced trade secrets litigators for a roster of marquee clients, many of them confidential.” The publication noted the rise in trade secrets matters as a result of remote work during the pandemic. “It’s more difficult for companies to protect their trade secrets when employees are at home in a less secure environment,” Eberhart said. “There’s greater opportunity for employees to take trade secrets while nobody appears to be watching.”

The Daily Journal acknowledged Snyder as a member of O’Melveny’s Executive Committee and “an expert in advising technology sector clients on complex trade secrets and patent disputes.” The publication also mentioned his representation of CareCentrix, where he asserted trade secrets misappropriation claims against a former employee who joined a competitor. Snyder “negotiated a deal that put the employee on leave pending a preliminary injunction ruling that he called a ‘highly favorable standstill agreement’ while the case proceeds.”

Snyder has overseen more than 30 cases in the past year, including Genentech Inc. v. JHL Biotech Inc., where the O’Melveny team representing JHL was led by both Snyder and Eberhart. The Daily Journal hailed their work on the case, mentioning their success in securing a more limited injunction than Genentech was seeking, allowing JHL to continue operating. “We showed that the scope of injunction they were seeking was not supported by the evidence,” Eberhart said. “Our client, the company, and its current CEO were not charged.”

The O’Melveny team reached a settlement that steered JHL in a new direction, entering into a non-prosecution agreement. “This had been an existential threat to our client, and it was our job to protect the company’s future, along with its investors. JHL can now move forward,” Snyder said. “The company feared a death sentence, but this was an example of how we pulled together a white collar team to work with us trade secrets lawyers,” Eberhart said, “I’m not a former prosecutor, so I collaborate when necessary–and I’ve done a dozen or so cases like this with parallel civil and criminal claims.”
