Petrocelli Named to Daily Journal’s “Top 100” List for Eighth Consecutive Year

CENTURY CITY—September 16, 2020—Dan Petrocelli, Chair of O’Melveny’s Trial Practice Committee, has been named to the Daily Journal’s “Top 100” list for the eighth year in a row. The annual roundup celebrates “California attorneys doing cutting-edge legal work.”

In his award profile, the publication recognized Petrocelli’s lawsuit on behalf of Twentieth Century Fox against Netflix for unlawfully poaching employees under contract. Arguing that employment contracts for a fixed term are valid and enforceable in California, Petrocelli obtained a permanent injunction against the streaming giant on a motion for summary judgement. The case had “industry-wide implications for entertainment companies who frequently compete for talent,” the Daily Journal noted.

Another victory for Fox included convincing the Court to vacate a US$128 million punitive damages award by an arbitrator in a profit participation dispute regarding the hit television series “Bones.” “The arbitrator had disregarded a provision in the arbitration agreement that barred punitives,” Petrocelli told the Daily Journal. “It is critically important that limitations be respected and faithfully followed.”
