Law360: Agent Says Authors Want Best Deal, Not Most Upfront Money

Former literary agent and William Morris Endeavor board member Jennifer Rudolph Walsh appeared as an expert witness for Penguin Random House in its defense against the DOJ’s challenge to its proposed merger with Simon & Schuster. O’Melveny partner and counsel for Penguin, Abby Rudzin, asked Walsh about competition from smaller publishers and their interpretation as “farm teams” for the Big 5 publishers. Walsh noted that small and midsize publishers compete “not as frequently, but just as fiercely’ as the Big 5 to acquire expensive book rights. Penguin is represented by Rudzin, Oppenheimer, Daniel M. Petrocelli, Andrew Frackman, Jonathan Hacker, Courtney Dyer, and Julia Schiller of O’Melveny & Myers LLP.
